Welcome to TheKultArt! These Terms explain what to expect when you shop with us or use our website (the "Site"). Using the Site — browsing, creating an account, or placing an order — means you're agreeing to these Terms and our Privacy Policy.
We update these Terms occasionally. When we do, the new version goes live here, and continuing to use the Site afterward means you're accepting it.
Who Can Shop With Us
You're welcome to browse the Site anytime. To place an order, you'll need to be of legal age in your country or region, and the information you give us — for your account or your order — needs to be accurate. We can decline or cancel orders where that information looks wrong or incomplete.
Your Account
Creating an account is optional but makes checkout faster. Keep your login details to yourself, and let us know right away if you think someone else has accessed your account. If an account is being misused or poses a security risk, we may suspend or close it.
Placing an Order
When you check out, you're making an offer to buy — we confirm that offer once your order ships, not before. We reserve the right to decline or adjust orders, whether due to stock issues, pricing mistakes, or anything that looks like fraud. If part of your order can't be fulfilled, we'll reach out and sort it out with you.
Pricing & Payment
Checkout runs through Shopify's secure payment system. By completing a purchase, you're authorizing us to charge your chosen payment method for the order total, taxes and shipping included. Prices can change at any time — we try to keep everything accurate, but errors happen, and colors especially can look a little different depending on your screen versus the real print.
Returns & Damage
Because every piece is made specifically for your order, our return process works a bit differently than off-the-shelf retail. Full details — including what to do if something arrives damaged — live in our Return Policy.
Ownership of the Artwork
The images and artwork on this Site belong to TheKultArt and/or the artist behind them. Browsing the Site doesn't give you any rights to that artwork beyond viewing it here.
When you buy a print, you own that physical piece — the paper, the frame, the object hanging on your wall — not the underlying image itself. That means no scanning it for resale, no reposting it commercially, no reproducing it in any format beyond enjoying it in your own space. Everything else on the Site — our writing, layout, and branding — is ours too, and shouldn't be copied without asking first.
Playing Fair on the Site
We want the Site to work well for everyone, so please don't try to break it, scrape it, overload it, or use it to impersonate someone else or spread anything harmful. Basic good-faith use is all we ask.
Changes We Might Make
We may tweak, pause, or shut down parts of the Site at any point — a feature, a page, sometimes more. We'll try to be transparent about it, but we're not liable if something changes.
No Promises, Just Honesty
We run the Site as carefully as we can, but we can't promise it'll always be perfect, uninterrupted, or bug-free. Everything here is offered "as is" — we're not making guarantees beyond what's explicitly stated in these Terms.
Limits on What We're Responsible For
If something goes wrong, our responsibility is capped — we won't be liable for indirect losses (lost profits, missed opportunities, that kind of thing), and our total liability for any order won't exceed what you paid for it.
If Something Goes Sideways
Should a dispute ever arise from your use of the Site, you agree to cover any legal costs or damages that come from misusing the Site or breaking these Terms — same as we'd expect to stand behind our own end of the deal.
The Legal Fine Print
These Terms are governed by Florida law. If part of this agreement turns out to be unenforceable somewhere, the rest still stands. Combined with our Privacy Policy, this is the whole agreement between you and TheKultArt.
